study of the causes and consequences of social and economic rights litigation.

INTRODUCTION: The first monograph study of the increasingly important
phenomena of people trafficking.
Incorporates historical and social
context with analysis of international legal instruments, treaties, and jus
cogens.
In recent decades the international community has focused its
attention on trafficking in persons, one of the most worrying phenomena of the
21st century. In Part I, this book examines trafficking in persons in the
light of the recent definition of the phenomenon given by the UN Trafficking
Protocol, and various other international legal instruments including treaties
and 'soft law'. It analyses trafficking causes and consequences, and the most
common forms of exploitation related to it.
Part II reviews the most
important international conventions against slavery and the slave trade, and
the Protocol to Prevent, Suppress and Punish Trafficking in Persons,
Especially Women and Children. It also analyses the most important policy
documents setting the basic standards of protection for trafficked victims -
namely the United Nations High Commissioner for Human Rights' Recommended
Principles and Guidelines on Human Rights and Human Trafficking - and comments
on the extension of the jus cogens principle of international law that
prohibits slavery, to argue that trafficking in persons ought rightly to be
considered a part of it.
Part III deals with the Council of Europe and
the European Union, and their fight against trafficking in people, arguing
that the focus has been placed mistakenly on the prosecution of traffickers
rather than on the protection of trafficked victims.
The book concludes
with a recommendation to shift towards a more balanced approach to trafficking
in persons, and the overriding need to conduct further research on specific
issues related to the spread of trafficking and the exploitation of its
victims.

INTRODUCTION: 'Structural adjustment' has been a central part of the
development strategy for the 'third world'. Loans made by the World Bank and
the IMF have been conditional on developing countries pursuing rapid economic
liberalization programmes as it was believed this would strengthen their
economies in the long run. M. Rodwan Abouharb and David Cingranelli argue
that, conversely, structural adjustment agreements usually cause increased
hardship for the poor, greater civil conflict, and more repression of human
rights, therefore resulting in a lower rate of economic development. Greater
exposure to structural adjustment has increased the prevalence of
anti-government protests, riots and rebellion. It has led to less respect for
economic and social rights, physical integrity rights, and worker rights, but
more respect for democratic rights. Based on these findings, the authors
recommend a human rights-based approach to economic development.

INTRODUCTION: One interesting mechanism of Socially Responsible Investment
(SRI) is the divestment arrangement for the Norwegian Government Pension Fund
(Global). The Norwegian Parliament established a Council on Ethics to advise
on the exclusion of certain corporations from the portfolio of the Fund, to
prevent complicity with violations of fundamental humanitarian principles,
serious violations of human rights, gross corruption or severe environmental
damage. The article explores two issues concerning this mechanism, one
practical and one normative. The first concerns the exclusion mechanism’s
implementation, the second what we are to make of efforts to impose normative
constraints on profit-seeking economic activity. Sections 1 and 2 present the
ethical guidelines and show how the Council decides on its recommendations.
Section 3 considers whether such SRI by large investors can be said to be
effective and legitimate responses to the new challenges wrought by economic
globalization. Section 4 indicates three of several possible roles the SRI may
play, while section 5 draws some conclusions. In particular, the Norwegian
government’s divestment efforts – primarily aimed at preventing complicity –
may serve to prevent wrong-doing by others under certain conditions.

important. Yet the future of children would not be secured unless their rights
are clearly identified, redefined and restored. All children must be given an
opportunity for development. The idea that children have special needs has
given way to the conviction that they have rights such as civil, political,
social, cultural and economic like adults have.

INTRODUCTION: The essays in this volume explore some of the diverse and
contradictory ways that the lives of women in the Asia-Pacific region are
shaped by two powerful regimes - 'religion' and 'law' - and by the
interactions between them. They show that for women, laws - customary,

INTRODUCTION: Are efforts to protect workers’ rights compatible with the
forces of globalization? How can minimum standards designed to protect labour
rights be implemented in a world in which national labour law is more and more
at the mercy of international forces beyond its control? And does it make any
difference if we see rights such as the right to freedom of association, to
non-discrimination in the workplace, to freedom from child labour, and to safe
and healthy working conditions in terms of international human rights law? Or
are they more appropriately seen as ‘principles’ to be promoted as and where
appropriate? The contributors to this volume argue that international
agreements and institutions are of central importance if labour rights are to
be protected in a globalized economy. But the report cards they give to the
World Trade Organization, the European Union,NAFTA, and the Free Trade
Agreement of the Americas are generally very critical. While there is a strong
rhetorical commitment to labour rights, at least on the part of the US and the
EU, the substance of what has been achieved to date is hardly impressive. The
role of the International Labour Organization is central and the authors

the biggest and most critical challenges facing international law today *

Under traditional approaches to human
rights, non-State actors are beyond the direct reach of international human
rights law. They cannot be parties to the relevant treaties and so they are
only bound to the extent that obligations accepted by States can be applied to
them by governments. The result is that entities including Non-Governmental
Organizations, international organizations such as the UN and the IMF, private
security contractors, and transnational corportaions, along with many others,
are generally considered not to be bound directly by human rights law.
This situation threatens to make a mockery of much of the international system
of accountability for human rights violations. As privatization, outsourcing,
and downsizing place ever more public or governmental functions into the hands
of private actors, the human rights regime must adapt if it is to maintain its
relevance. The contributors to this volume examine the different approaches
that might be taken in order to ensure some degree of accountability. Making
space in the legal regime to take account of the role of non-State actors is
one of the biggest and most critical challenges facing international law
today.

INTRODUCTION: The article questions the normative universality of
children's rights by considering the ideal definition of childhood implicit in
the UN Convention on the Rights of the Child and other international law
documents. It questions whether this definition has any universal purchase in
light of different conceptions of childhood held across the world. The article
distinguishes between rights that children have as human beings, and rights
they are regarded as having by virtue of their age. The latter are regarded as
problematic and the article illustrates this with examples that challenge the
conception of childhood underlying the CRC. The article presents alternatives
that may conflict with the assumptions underlying the CRC, and challenges the

INTRODUCTION: Description There is mounting evidence that the economic
globalisation project initiated after the fall of the Soviet Union is not
keeping its promise of open societies and a freer exchange of goods,
knowledge, ideas and more social justice. In fac, there are strong indications
that such benefits are not equally divided, so between north and south and
developed and developing countries. Responding to this evidence, the
International Labour Organisation (ILO) established the World Commission on
the Social Dimension of Globalisation in February 2002. In February 2004,

the Commission s report, A Fair Globalization: Creating Opportunities for All,
was presented to the Governing Body of the International Labour Organization,
to the Secretary General of the United Nations, and to the heads of other UN
agencies, the World Bank, the International Monetary Fund, and the World Trade
Organization. This volume represents the first in-depth evaluation of this
important report.
The analyses and commentaries collected in this
volume accomplish two essential tasks. They detail the findings and
recommendations of the Commission, and they also spell out the implications of
the Commission s report for the ongoing viability of economic globalisation in
practice. The authors include ILO officials, representatives of both employers
and labour unions, specialists in various work-related professions, and
academics in disciplines related to work and society. Among the vital issues

adequate environment ought to be provided in the constitution of any modern
democratic state. The importance of securing provision for environmental
